1. Acceptance of Terms

By accessing or using IconBrain ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

IconBrain is an AI-powered icon generation service that allows users to create custom icons using artificial intelligence. The Service operates on a credit-based system where users purchase credits to generate icons.

3. User Accounts

To use the Service, you must create an account using Google authentication. You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

4. Credits and Payments

  • Credits are purchased through our payment processor (Stripe)
  • Each icon generation costs 4 credits
  • Credits never expire
  • Credits are non-refundable except where required by law
  • All prices are in USD unless otherwise stated

5. Intellectual Property

Generated Icons: You own full rights to icons generated through the Service. You may use them commercially without attribution for any lawful purpose including:

  • App store submissions (iOS, Android)
  • Website favicons and branding
  • Marketing materials
  • Resale as part of a product or service

Service Content: The IconBrain name, logo, website design, and underlying technology remain our intellectual property.

6. Acceptable Use

You agree not to use the Service to generate content that is:

  • Illegal or promotes illegal activities
  • Infringing on third-party intellectual property rights
  • Harmful, threatening, or harassing
  • Deceptive or fraudulent
  • Containing malware or harmful code

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

8. Limitation of Liability

To the maximum extent permitted by law, IconBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.
